OpenAvatar — Terms of Service

These terms govern your use of the OpenAvatar macOS application ("the app"). By installing or using the app, you agree to them. If you do not agree, do not use the app.
1. What OpenAvatar is
OpenAvatar is a local‑first tool that transcribes your calls on your Mac and helps you prepare and carry out actions (such as creating tickets, sending messages, or drafting emails) across services you connect. It acts on your behalf and under your direction. Actions it takes are attributed to you and marked as assistant‑performed (a 🤖 indicator) where the target service allows.
2. Your responsibilities
- Recording and consent. You are responsible for complying with all laws that apply to recording, transcribing, or processing conversations, including obtaining the consent of other participants where required (many jurisdictions require all‑party consent). OpenAvatar gives you an always‑visible recording indicator and never records unless you turn listening on; using it lawfully is your responsibility.
- Your accounts and keys. You supply your own credentials and API keys for the AI providers and integrations you connect, and you are responsible for their use, costs, and for complying with those providers' terms.
- Review before acting. You are responsible for reviewing and approving actions. The app can prepare and, where you allow it, perform actions; you are responsible for their consequences.
- Lawful use. You agree not to use the app to violate any law or the rights of others.
3. AI output
Decisions, drafts, and actions are generated with the help of AI models and may be inaccurate or incomplete. Do not rely on them as professional advice. Review important output before acting on it.
4. Third‑party services
The app interoperates with third‑party services you choose to connect. We do not control those services, and your use of them is governed by their own terms and privacy policies. Names and logos of third‑party products are the property of their respective owners; OpenAvatar is not affiliated with or endorsed by them.
5. Software license
The app is distributed as described in the project's repository. To the extent a separate open‑source license is provided with the app, that license governs your rights to the software; these terms govern your use of the service behaviors described here.
6. No warranty
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. We do not warrant that the app will be error‑free, uninterrupted, or that transcripts or actions will be accurate.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
8. Changes
We may update these terms. Changes take effect when posted at this URL with an updated effective date; material changes will be noted in the app's release notes. Continued use after a change means you accept the updated terms.
